Congolese on Friday did not have a chance of watching live on state Television an appeal trial for Vital Kamerhe who had been sentenced to 20 years of hard labour after pleading guilty to all counts in a massive fraud case. This appeal case involves Vital Kamerhe and Samih Jammal at the Kinshasa based Gombe Court of Appeal. During their sentence about a month ago, the Gombe tribunal de grande instance said the two men were guilty of embezzling public funds in the amount of U$ 48,831,148 and as a result, sentenced them each to 20 years of forced labor. The sentence also included banning Vital Kamerhe and Samih Jammal from voting. The two will not have a right to vote for a period of ten years and cannot stand for any election. They are also prohibited from access to public and parastatal functions at any level by the same defendant. The court had also ordered the confiscation of funds contained in the accounts of relatives of Kamerhe including his daughter-in-law Soraya Mpiana, Daniel Nshangalume or his wife Amida Chatur as well as “real estate acquired thanks to embezzled funds”. The appeal is a means of recourse that the sentenced person can exercise against a judgment rendered in contravention, correctional or criminal matters. It allows the case to be re-examined by another or other magistrate (s) making up the Court of Appeal.
